Armed Forces Disability Pension rules have been changed and new rules come into effect from 21 September 2023 onwards. The revised regulation has made significant changes in the traditional rules and modified it as Rules of Casualty Pension and Disability Compensation Award to Arm Forces Personnel 2023.

Armed Forces Disability Pension

The Ministry of Defense has announced some changes in the traditional rules of the Arm Forces Disability Pension. The rules will be modified to make the process more genuine and profitable. This rule set was introduced on 21 September and replaces previous rules. This change was named as Entitlement Rules of Casualty Pension and Disability Compensation Award to Arm Forces Personnel 2023.

The new regulations replace the previous ones on disability benefits for members of the armed services. The new regulations have modified the definition, computation process, and eligibility requirements.

The revised regulations modify the terms, disabilities included, and methodologies for calculating the proportion of a person with a disability. According to the study, these adjustments will have a financial impact and will affect the pension payments qualified members of the military services receive.

The new guidelines have also updated the categories of infirmities and replaced the phrase “disability element” with “impairment relief.”

The phrase “disability element” has been replaced with the idea of “impairment relief.” This alleviation will now include lifestyle illnesses including Type-2 diabetes and hypertension, extending the range of disorders that are covered.

Only members of the military services who get illnesses or develop impairments while serving, notably in high-altitude environments or as a result of severe physical effort, are eligible for disability pensions. Cadets and officer candidates will be given an ex-gratia payment instead of disability compensation.

Casualty Pension & Disability Compensation Rule Changes

An inter-services group conducted a thorough study that led to these improvements. The study was started as a result of concerns expressed in a Comptroller and Auditor General (CAG) report regarding the high number of officers, particularly medical officers, seeking disability pensions. The Defence Ministry reportedly reviewed and revised the current procedures after the audit watchdog questioned the causes of this mismatch.

According to Regulation 95 of Army 2008 Part I, a soldier who was put in a permanent LMC by SHAPE-1 but refused to accept a sheltered assignment would be released from service and considered to have been invalidated out of service. According to Regulations 81 and 82, disability pensions that include both a service element and a disability element are acceptable in all invalid situations where the disability has been made worse by or is due to military service.

Impact of Armed Forces Disability Pension New Rule

There are three kinds of medical invalid instances, according to the Entitlement Rules of Casualty Pensioners 2008, which were published in 2010. There are just two categories in the most recent orders for the Entitlement Rules 2023, dated September 21, 2023.

The list of invalid cases has been updated to exclude instances that were unwilling to accept sheltered appointments. Therefore, all cases of sheltered appointment refusal will not be recognized as being invalidated out of service, under the most recent ruling.

Ex-Serviceman Armed Forces Disability Pension

The MoD claims that these adjustments are required, but the All India Ex-Servicemen Welfare Association has expressed reservations. According to a story in the Indian Express, they contend that the new regulations disfavor soldiers in comparison to civilian employees because they require 10 years of service in order to qualify for an invalid pension.

The group also draws attention to differences in how illnesses, particularly cardiac conditions, are related to military service. They emphasize that stress and strain can happen independently of the location of the posting and contest the new guidelines’ changed definitions of disorders and disabilities.
